These Terms of Service (“Terms”) govern your use of Afterword, a personal legacy planning service operated by En Vivant Pty Ltd (“Afterword”, “we”, “us”, “our”). By creating an account or purchasing a plan, you agree to these Terms in full.
These Terms are governed by the laws of New South Wales, Australia. Your statutory rights under the Australian Consumer Law (ACL) are not limited or excluded by these Terms.

Our service is available to individuals aged 18 years and over. By using Afterword, you confirm that you are at least 18 years of age.
To use Afterword, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at [email protected] if you suspect unauthorised use of your account.

We reserve the right to change our pricing at any time. Any pricing changes will be communicated to existing customers with at least 30 days' notice and will not affect your existing plan unless you upgrade or modify it.
Payments are processed securely by Stripe. By providing payment information, you authorise us to charge the applicable fees. Annual check-in fees are charged annually (or bi-annually, at your election) from the anniversary of your purchase date, with Year 1 included in your one-time plan fee.
For Gifts plans, item costs are charged at the time of dispatch based on current pricing. We will notify your executor of the estimated item cost before dispatching.
You may cancel your plan within 5 business days of your initial purchase for a full refund of all amounts paid. No reason is required. To cancel within the cooling-off period, contact us at [email protected].
After the 5-business-day cooling-off period, the following refund policy applies:
A portion of each paid plan covers work performed at the time of purchase (account setup, plan configuration, onboarding). This portion is non-refundable once onboarding has commenced after the cooling-off period.
The remaining portion of your plan fee is held as a service delivery reserve. If you cancel before any items have been dispatched, this portion will be refunded to your original payment method within 10 business days.
Annual check-in fees are refunded on a pro-rata basis for any unused portion of the annual period at the time of cancellation.
If you cancel a Heirloom plan, your physical items will be returned to a nominated address within 30 days of cancellation at your cost. If items cannot be returned (due to no valid address being provided within 30 days), we will make reasonable efforts to contact you before taking any further action. Annual safeguarding fees are refunded pro-rata on cancellation.
If an annual check-in payment fails and is not resolved within 30 days of notification, we will attempt to contact you via email and phone. If payment remains outstanding after 60 days, we reserve the right to suspend your plan. For Heirloom plans where a payment failure cannot be resolved: in lieu of disposal, we will treat the plan as having been triggered (executing delivery to your nominated recipients as if your plan had been activated), provided we have been able to verify with your executor that this is appropriate.
You may transfer your Afterword plan to another individual for a 25% administration fee calculated on the original plan price. Transfers are subject to the new holder accepting these Terms in full. Contact us at [email protected] to arrange a transfer.
For all paid plans, we conduct an annual wellness check-in by phone. This call is used to verify that you are well and to review and update your plan, recipient details, and any other relevant information. If you do not respond to a check-in attempt within 30 days, we will notify your nominated executor to follow up independently. This is a protective measure designed to ensure your plan remains current and is not triggered in error.
Your plan is activated by your nominated executor following your passing. Before any items are dispatched, we require:
We will not dispatch any items based on a single notification alone. This dual-verification requirement is non-negotiable and exists solely to protect your loved ones.
For Gifts plan holders, we will use reasonable endeavours to source the exact items you nominate. Where an exact match is unavailable at the time of dispatch, we will source the closest reasonable alternative. Item costs are charged to the executor's payment method at dispatch. We aim to match your exact wish; where an item is not available, we will consult with your executor before substituting.
Gift items are not included in or pre-purchased as part of the plan fee. The plan fee covers our service, sourcing, and dispatch — not the items themselves.
For Heirloom plan holders, the following conditions apply to physical items you send to us for storage:
We maintain a service delivery reserve from each plan payment, held separately from our operating funds. We have structured a service continuity agreement with a nominated trustee firm who, in the event that Afterword or En Vivant Pty Ltd ceases to operate, will take over the obligations of outstanding plans and ensure they are honoured. Details of this arrangement are available on request.
You retain ownership of all content you upload to Afterword, including letters, messages, recordings, and photos (“Your Content”). By uploading content, you grant us a limited, non-exclusive licence to store, process, and deliver Your Content solely for the purpose of performing our service.
We will not access, share, or use Your Content for any purpose other than delivering your plan, except as required by law.
You must not use Afterword to store or deliver content that:
We reserve the right to remove content or suspend accounts that violate these Terms, without refund where such violation is deliberate.
To the maximum extent permitted by the Australian Consumer Law, our liability for any failure or delay in delivering your plan is limited to re-performing the relevant service or, at our election, refunding the applicable portion of your plan fee. We are not liable for consequential, indirect, or special damages.
Nothing in these Terms limits your rights under the Australian Consumer Law in relation to consumer guarantees.
Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.
We may update these Terms from time to time. We will notify you of material changes by email at least 30 days in advance. Continued use of Afterword after the effective date of updated Terms constitutes acceptance.
These Terms are governed by the laws of New South Wales, Australia. In the event of a dispute, we encourage you to contact us first at [email protected] so we can resolve the matter directly. If a dispute cannot be resolved informally, it will be submitted to the courts of New South Wales.
